Terms of Service

These Terms govern your use of the Wingman AI app and website. Wingman is published by Perch Labs, an individual developer based in Kenya and not an incorporated company (“Perch Labs”, “we”, “us”). By using Wingman you agree to these Terms. If you don't agree, please don't use the app.

1. Eligibility and your account

You must be at least 18 years old and able to enter into a binding agreement. You sign in with a Google or Apple account through our sign-in provider. Keep your sign-in secure; you are responsible for activity on your account. One person, one account.

2. The service

Wingman uses AI to suggest replies to messages you type or to a screenshot of a chat, in the style you choose (confident, funny, flirty, romantic or chill). It also offers Discover, with openers, flirty lines, date ideas and conversation tips; a Profile with your setup answers, saved replies (favorites) and progress stats that follow your account to a new phone; an optional daily reminder; and ways to send feedback or report a reply. Suggestions are generated automatically and may be inaccurate, awkward or unsuitable. You are responsible for what you choose to send and how you use it.

3. Acceptable use

You agree not to use Wingman to:

• harass, threaten, stalk, deceive, or pressure anyone;
• send content that is sexually explicit involving minors, hateful, or illegal;
• impersonate others or run scams;
• upload content you have no right to share, or that violates someone's privacy;
• reverse engineer, scrape, bypass the free allowance or usage limits, or otherwise abuse the service.

Respect consent: if someone isn't interested, stop. If a suggestion is unsuitable you can report it in the app. We may limit or end access for violations.

4. Free replies and fair use

• Free allowance: every account gets 3 free AI generations in total (not per month). One generation is one tap on Generate, which returns a few reply suggestions. The count is kept on our servers against your account, so reinstalling the app or signing in on another phone does not reset it.
• A generation that fails because of an error on our side or the AI provider's is given back. A request the AI declines for safety reasons still counts.
• When your free generations are used up, AI generation is locked until you subscribe. The rest of the app (Discover, Profile, your saved replies and settings) keeps working, and you can close the paywall at any time.
• Fair use: to keep the service available and affordable, AI replies are limited to 30 in any 24 hours and 100 in any 30 days, plus a short per-minute limit. These limits are the same for free and Pro accounts and the oldest replies roll off the count as time passes. We may change the free allowance and the limits, with notice in the app.

5. Wingman Pro, pricing and billing

• Pro unlocks AI generation after your free replies, with screenshot analysis, the advanced AI model, all conversation styles and priority support, within the fair-use limits above.
• Free trial: all plans start with a 3-day free trial for eligible new subscribers (the App Store or Google Play decides eligibility). You are not charged until the trial ends. Cancel at least 24 hours before it ends in your App Store or Google Play subscription settings to avoid being charged.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Prices may vary by region and store, and local taxes may apply.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your App Store or Google Play subscription settings. Deleting the app or your Wingman account does not cancel your subscription.
• You can restore a previous purchase from the paywall. Subscriptions are managed through RevenueCat on top of the stores.
• Refunds are handled by Apple or Google under their policies.
• We may change prices for future billing periods with notice where required.

6. Your content

You keep ownership of the messages and screenshots you submit. You give us a limited licence to process them, including by sending them to our AI provider, only to provide the service, as described in our Privacy Policy. Reply suggestions are yours to use.

7. Our rights

The app, the Wingman AI name, design and software belong to Perch Labs and its licensors. We grant you a personal, non-transferable, revocable licence to use the app. The App Store and Google Play have their own standard terms for apps downloaded through them, and those apply in addition to these Terms.

8. Disclaimers

Wingman is provided “as is” and “as available”. We don't guarantee particular outcomes in dating or relationships, and Wingman is not professional relationship, mental health or legal advice.

9. Limitation of liability

To the fullest extent permitted by law, Perch Labs is not liable for indirect, incidental or consequential damages, or for losses arising from messages you send. Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits any right you have under Kenyan consumer protection law or any other law that cannot be limited by agreement.

10. Termination and deleting your account

You can stop using Wingman at any time, and you can delete your account in Profile → Delete account & data. We may suspend or end access if you breach these Terms or misuse the service.

11. Changes

We may update these Terms. We will change the date above and, for significant changes, tell you in the app. Continued use after changes means you accept them.

12. Governing law and disputes

These Terms are governed by the laws of Kenya. Please contact us first so we can try to resolve any problem informally. If that doesn't work, disputes will be handled by the courts of Kenya, except where mandatory consumer law in your country says otherwise.
